ही स्पर्धा नाही. तुम्हाला समजलेला एखाद्या मराठी कवितेचा अर्थ लोकांपर्यंत पोहोचवण्यासाठी 'ये हृदयीचे ते हृदयी' या कार्यक्रमात आम्ही कवितेची ओळख, रसग्रहण किंवा समीक्षात्मक लेखन मागवत आहोत.

१. कविता मराठी असावी. प्रवेशिकेसोबत संपूर्ण कविता, कवी/कवयित्रीचे नाव द्यावे.

२. प्रवेशिका लिखीत (स्कॅन स्वरुपात) किंवा ई-पत्रामध्ये देवनागरीत पाठवता येतील. आलेल्या प्रवेशिकेतील साहित्य प्रकाशित करताना त्यावर कोणतेही संस्करण केले जाणार नाही. एका व्यक्तीला एकापेक्षा जास्त प्रवेशिका पाठवता येतील.

३. प्रवेशिका marathibhasha@maayboli.com या पत्त्यावर पाठवावी.सोबत आपला मायबोलीवरचा आयडी कळवावा. प्रवेशिका पाठवताना ई-पत्राच्या विषयात कृपया Marathi Bhasha : rasagrahaN असे नमूद करावे.

४. प्रवेशिका पाठवण्याची अंतिम तारीखः २० फेब्रुवारी २०११

५. ज्या कवितेचे रसग्रहण केले जाणार आहे ती प्रताधिकारमुक्त असावी. प्रताधिकारमुक्त साहित्य असल्यास परवानगीची गरज नाही. परंतु याशिवाय मूळ लेखकाची परवानगी घेऊन रसग्रहण करता येईल. मूळ लेखकाची परवानगी मिळवण्याची कायदेशीर जबाबदारी रसग्रहण लिहिणार्‍याची आहे. मायबोली या गोष्टीला जबाबदार असणार नाही.

एखाद्या कवितेचे रसग्रहण देताना संपूर्ण कविताही वाचकांच्या सोयीसाठी तिथेच असायला हवी. विशेषतः ती अनोळखी असेल तर नक्कीच. मग यासंदर्भात प्रताधिकाराच्या अनुषंगाने काय करणार?

नीधपला अनुमोदन. मीही हेच विचारायला आले होते.

माननीय संयोजक,
उपक्रम फार आवडला.
अत्यंत नाईलाजाने हा प्रश्न विचारते आहे, कारण तो प्रश्न उद्भवेलच. प्रताधिकाराचे काय करणार?

विचार करता करता हे सुचले. आपणांस काही उपयोग होईल तर पहा. जर त्या प्रताधिकार झेंगटामुळे हे रद्द करायची वेळ आली तर
१) मूळ कविता न देता नुसते रसग्रहण द्यावे. (अत्यंत अत्यंत दुर्दैवी.) Sad
२) आशूच्या सूचनेनुसार आवडती साहित्यकृती (कथा/कविता/कादंबरी/नाटक) असा उपक्रम घेऊ शकाल. त्यात लोकं काहीही लिहू शकतील आणि कुठल्याही रचनेतील मूळ वाक्ये द्यायचा प्रश्न उद्भवणार नाही.

(कायदा आणि हेतू यांच्यात काहीही ताळमेळ राहू नये अशा सर्वच कायद्यांची कीव येते. वैयक्तिक मत.)

माझ्या माहितीप्रमाणे जर कविता आणि तिचे रसग्रहण दोन्ही एकत्र दिले असेल तर त्यामुळे प्रताधिकाराचा भंग होत नाही. कारण त्याचा अर्थ कविता 'चोरली' किंवा 'फायद्यासाठी वापरली' असा होऊ शकत नाही. एखाद्या कलाकृतीचा रसास्वाद घेणे, ती का आवडते किंवा आवडत नाही हे दुसर्‍याला सांगणे हा गुन्हा होत नाही.

माफ करा पण आम्हाला मिळालेल्या अधिक माहितीनुसार ज्या कवितेचे रसग्रहण केले जाणार आहे ती प्रताधिकारमुक्त असावी. किंवा मूळ लेखकाची परवानगी घेऊन रसग्रहण करता येईल. त्यानुसार वरच्या पोस्ट मधे नियम क्र. ५ दिला आहे.

इंडियन कॉपीराईट अ‍ॅक्ट, १९५७ हा भारतासाठी लागू आहे. त्यातले कलम ५२ खाली लिहिले आहे. त्यातील ठळक केलेल्या भागाचा अर्थ ज्याने त्याने आपापल्या मनाप्रमाणे लावावा. माझ्या बुद्धीला जो पटला तो मी लावलेला आहे.

हा कायदा सध्या बदलत आहे ज्याचे बिल अजून पास झालेले नाही. पण ठळक केलेला भाग बदलणार नाही. Happy

52. Certain acts not to be infringement of copyright.
(1) The following acts shall not constitute an infringement of copyright, namely —
(a) a fair dealing with a literary, dramatic, musical or artistic any work not being a
computer programme, for the purposes of —
(i) private or personal use, including research;
(ii) criticism or review, whether of that work or of any other work;
(iii) the reporting of current events, including the reporting of a lecture delivered in
public.
Explanation. The storing of any work in any electronic medium for the purposes
mentioned in this clause, including the incidental storage of any computer
programme which is not itself an infringing copy for the said purposes, shall not
constitute infringement of copyright.
(aa) the making of copies or adaptation of a computer programme by the lawful possessor
of a copy of such computer programme, from such copy —
(i) in order to utilise the computer programme for the purposes for which it was
supplied; or
(ii) to make back-up copies purely as a temporary protection against loss, destruction
or damage in order only to utilise the computer programme for the purpose for
which it was supplied;
(ab) the doing of any act necessary to obtain information essential for operating interoperability
of an independently created computer programme with other programmes
by a lawful possessor of a computer programme provided that such information is not
otherwise readily available;
(ac) the observation, study or test of functioning of the computer programme in order to
determine the ideas and principles which underlie any elements of the programme
while performing such acts necessary for the functions for which the computer
programme was supplied;
(ad) the making of copies or adaptation of the computer programme from a personally
legally obtained copy for non-commercial personal use;
(b) a fair dealing with a literary, dramatic, musical or artistic work for the purpose of
reporting current events —
(i) in a newspaper, magazine or similar periodical, or
(ii) by broadcast or in a cinematograph film or by means of photographs.
Explanation.-The publication of a compilation of addresses or speeches delivered in
public is not a fair dealing of such work within the meaning of this clause;
(b) the transient and incidental storage of a work or performance purely in the technical
process of electronic transmission or communication to the public;
(c) transient and incidental storage for the purpose of providing electronic links, access or
integration, where such links, access or integration has not been expressly prohibited
by the right holder, unless the person responsible is aware or has reasonable grounds
for believing that such storage is of an infringing copy;
Provided that if the person responsible has prevented the storage of a copy on a
complaint from any person, he may require such person to produce an order within 14
days from the competent court for the continued prevention of such storage.
(c) (d) the reproduction of a literary, dramatic, musical or artistic any work for the purpose
of a judicial proceeding or for the purpose of a report of a judicial proceeding;
(d) (e) the reproduction or publication of a literary, dramatic, musical or artistic any work
prepared by the Secretariat of a Legislature or, where the Legislature consists of two
Houses, by the Secretariat of either House of the Legislature, exclusively for the use of
the members of that Legislature;
(e) (f) the reproduction of a literary, dramatic, musical or artistic any work in a certified
copy made or supplied in accordance with any law for the time being in force;
(f) (g) the reading or recitation in public of any reasonable extract reasonable extracts from
a published literary or dramatic work;
(g) (h) the publication in a collection, mainly composed of non-copyright matter, bona fide
intended for the use of educational institutions instructional use, and so described in
the title and in any advertisement issued by or on behalf of the publisher, of short
passages from published literary or dramatic works, not themselves published for the
use of educational institutions such use, in which copyright subsists:
Provided that not more than two such passages from works by the same author are
published by the same publisher during any period of five years.
Explanation. In the case of a work of joint authorship, references in this clause to
passages from works shall include references to passages from works by any one or
more of the authors of those passages or by any one or more of those authors in
collaboration with any other person;
(h) (i) the reproduction of a literary, dramatic, musical or artistic any work —
(i) by a teacher or a pupil in the course of instruction; or
(ii) as part of the questions to be answered in an examination; or
(iii) in answers to such questions;
(i) (j) the performance, in the course of the activities of an educational institution, of a
literary, dramatic or musical work by the staff and students of the institution, or of a
cinematograph film or a sound recordings if the audience is limited to such staff and
students, the parents and guardians of the students and persons directly connected
with the activities of the institution or the communication to such an audience of a
cinematograph film or sound recording.
(j) the making of sound recordings in respect of any literary, dramatic or musical work, if —
(i) sound recordings of that work have been made by or with the licence or consent of
the owner of the right in the work;
(ii) the person making the sound recordings has given a notice of his intention to make
the sound recordings, has provided copies of all covers or labels with which the
sound recordings are to be sold, and has paid in the prescribed manner to the
owner of rights in the work royalties in respect of all such sound recordings to be
made by him, at the rate fixed by the Copyright Board in this behalf:
Provided that —
(i) no alterations shall be made which have not been made previously by or with
the consent of the owner of rights, or which are not reasonably necessary for
the adaptation of the work for the purpose of making the sound recordings;
(ii) the sound recordings shall not be issued in any form of packaging or with any
label which is likely to mislead or confuse the public as to their identity;
(iii) no such sound recording shall be made until the expiration of two calendar
years after the end of the year in which the first sound recording of the work
was made; and
(iv) the person making such sound recordings shall allow the owner of rights or his
duly authorised agent or representative to inspect all records and books of
account relating to such sound recording:
Provided further that if on a complaint brought before the Copyright Board to
the effect that the owner of rights has not been paid in full for any sound
recordings purporting to be made in pursuance of this clause, the Copyright
Board is, prima facie, satisfied that the complaint is genuine, it may pass an
order ex parte directing the person making the sound recording to cease from
making further copies and, after holding such inquiry as it considers necessary,
make such further order as it may deem fit, including an order for payment of
royalty;
(k) the causing of a recording to be heard in public by utilising it, —
(i) in an enclosed room or hall meant for the common use of residents in any residential
premises (not being a hotel or similar commercial establishment) as part of the
amenities provided exclusively or mainly for residents therein; or
(ii) as part of the activities of a club or similar organisation which is not established or
conducted for profit;
(iii) as part of the activities of a club, society or other organisation which is not
established or conducted for profit;
(l) the performance of a literary, dramatic or musical work by an amateur club or society, if
the performance is given to a non-paying audience, or for the benefit of a religious
institution;
(m) the reproduction in a newspaper, magazine or other periodical of an article on current
economic, political, social or religious topics, unless the author of such article has
expressly reserved to himself the right of such reproduction; [note: the 'notes on
clauses' part of the Bill says this sub-clause is to be deleted, but the main text of the
bill itself, in s.31, does not speak of this sub-clause. -ed.]
(n) the publication in a newspaper, magazine or other periodical of a report of a lecture
delivered in public;
(n) the storing of a work in any medium by electronic means by a non-commercial public
library, for preservation if the library already possesses a non-digital copy of the work;
(o) the making of not more than three copies of a book (including a pamphlet, sheet of
music, map, chart or plan) by or under the direction of the person in charge of a
non-commercial public library for the use of the library if such book is not available for
sale in India;
(p) the reproduction, for the purpose of research or private study or with a view to
publication, of an unpublished literary, dramatic or musical work kept in a library,
museum or other institution to which the public has access:
Provided that where the identity of the author of any such work or, in the case of a
work of joint authorship, of any of the authors is known to the library, museum or other
institution, as the case may be, the provisions of this clause shall apply only if such
reproduction is made at a time more than sixty years from the date of the death of the
author or, in the case of a work of joint authorship, from the death of the author whose
identity is known or, if the identity of more authors than one is known from the death
of such of those authors who dies last;
(q) the reproduction or publication of —
(i) any matter which has been published in any Official Gazette except an Act of a
Legislature;
(ii) any Act of a Legislature subject to the condition that such Act is reproduced or
published together with any commentary thereon or any other original matter;
(iii) the report of any committee, commission, council, board or other like body
appointed by the Government if such report has been laid on the Table of the
Legislature, unless the reproduction or publication of such report is prohibited by
the Government;
(iv) any judgement or order of a court, tribunal or other judicial authority, unless the
reproduction or publication of such judgment or order is prohibited by the court,
the tribunal or other judicial authority, as the case may be;
(r) the production or publication of a translation in any Indian language of an Act of a
Legislature and of any rules or orders made thereunder —
(i) if no translation of such Act or rules or orders in that language has previously been
produced or published by the Government; or
(ii) where a translation of such Act or rules or orders in that language has been
produced or published by the Government, if the translation is not available for sale
to the public:
Provided that such translation contains a statement at a prominent place to the
effect that the translation has not been authorised or accepted as authentic by the
Government;
(s) the making or publishing of a painting, drawing, engraving or photograph of a work of
architecture or the display of a work of architecture;
(t) the making or publishing of a painting, drawing, engraving or photograph of a
sculpture, or other artistic work failing under sub-clause (iii) of clause (c) of section 2,
if such work is permanently situate in a public place or any premises to which the
public has access;
(u) the inclusion in a cinematograph film of —
(i) any artistic work permanently situate in a public place or any premises to which the
public has access; or
(ii) any other artistic work, if such inclusion is only by way of background or is
otherwise incidental to the principal matters represented in the film;
(v) the use by the author of an artistic work, where the author of such work is not the
owner of the copyright therein, of any mould, cast, sketch, plan, model or study made
by him for the purpose of the work:
Provided that he does not thereby repeat or imitate the main design of the work;
(w) the making of a three-dimensional object from a two-dimensional artistic work such as
a technical drawing, for the purposes of industrial application of any purely functional
part of a useful device.
(x) the reconstruction of a building or structure in accordance with the architectural
drawings or plans by reference to which the building or structure was originally
constructed :
Provided that the original construction was made with the consent or licence of the
owner of the copyright in such drawings and plans;
(y) in relation to a literary, dramatic, artistic or musical work recorded or reproduced in any
cinematograph film the exhibition of such film after the expiration of the term of
copyright therein:
Provided that the provisions of sub-clause (ii) of clause (a), sub-clause (a) of clause
(b) [sic] and clauses (d) [sic], (f) [sic], (g) [sic], (m) [sic] and (p) [sic] shall not apply
as respects any act unless that act is accompanied by an acknowledgement —
(i) identifying the work by its title or other description; and
(ii) unless the work is anonymous or the author of the work has previously agreed or
required that no acknowledgement of his name should be made, also identifying
the author.
(z) the making of an ephemeral recording, by a broadcasting organisation using its own
facilities for its own broadcast by a broadcasting organisation of a work which it has
the right to broadcast; and the retention of such recording for archival purposes on the
ground of its exceptional documentary character;
(za) the performance of a literary, dramatic or musical work or the communication to the
public of such work or of a sound recording in the course of any bona fide religious
ceremony or an official ceremony held by the Central Government or the State
Government or any local authority.
Explanation. For the purpose of this clause, religious ceremony including a marriage
procession and other social festivities associated with a marriage.
(zb) the adaptation, reproduction, issue of copies or communication to the public of any
work in a format, including sign language, specially designed only for the use of
persons suffering from a visual, aural or other disability that prevents their enjoyment
of such works in their normal format.
(zc) the importation of copies of any literary or artistic work, such as labels, company logos
or promotional or explanatory material, that is purely incidental to other goods or
products being imported lawfully.

(f) (g) the reading or recitation in public of any reasonable extracts from
a published literary or dramatic work;
>>> reasonable extract - हे अत्यंत महत्त्वाचे आहे.
एक्स्ट्रॅक्ट म्हणजे फक्त काही भाग. तेव्हा रसग्रहण करताना संपूर्ण कविता आधी लिहून नंतर त्याचा भावानुवाद/ रसग्रहण करणे योग्य नाही. ते कायद्यालाही अपेक्षित नाही.
एखाद्या पुस्तकाचे/ चित्रपटाचे जेव्हा परिक्षण/ रसग्रहण केले जाते तेव्हा संपूर्ण पुस्तक/ चित्रपटाची कथा आधी लिहून मग ते केले जात का? तद्वतच, कविता ही देखील एक संपूर्ण कलाकृती आहे. केवळ तिची लांबी कमी आहे म्हणून ती संपूर्ण लिहून काढू नये. हे त्या कलाकृतीसाठी तर अन्यायकारक आहेच, शिवाय कायद्याचाही भंग होतो, ते वेगळेच.

कायदा पाळायचा की नाही, कोण बघतंय, काही होत नाही, सगळे असंच करतात- ह्या मुद्द्यांना किती वजन आणि मान द्यायचा हे प्रत्येकाच्या दृष्टीकोनावर अवलंबून आहे, अर्थात व्यक्तीसापेक्ष आहे!

महत्त्वाचे- ज्या कवितांचा प्रताधिकार कवी/ प्रकाशकाकडे राखीव आहे त्यालाच हे सर्व अ‍ॅप्लिकेबल आहे.
प्रताधिकारमुक्त साहित्यासाठी नाही.

"reading or recitation" हे शब्द वरच्या पोस्टमध्ये सगळ्यात जास्त रिलेव्हंट आहेत. त्याचा सरळ सोपा अर्थ म्हणजे "(कार्यक्रमात) वाचून दाखवणे". आपण कुणाला काही वाचून दाखवणार नाही.

कायदा बनवणार्‍यांना काय अपेक्षित आहे? एकाच्या बौद्धिक संपदेचा दुसर्‍याने स्वतःच्या किंवा त्रयस्थ व्यक्तीच्या 'आर्थिक' फायद्यासाठी उपयोग करू नये.

मी दिलेला परिच्छेद 52.1 a (ii) आपल्या रसग्रहणाच्या बाबतीत अत्यंत स्पष्ट आहे.

कुणाकडे कुठला केस लॉ उपलब्ध आहे का? म्हणजे ही गोष्ट आपल्या दृष्टीने क्लियर होईल.

एक गोष्ट इथे स्पष्ट करतो. फक्त रसग्रहण करणार असाल तर परवानगीची आवश्यकता नाही. तसेच प्रताधिकारमुक्त असलेल्या कवितांचा रसग्रहणात पूर्ण उल्लेख करू शकता. प्रश्न फक्त प्रताधिकारमुक्त नसलेल्या कवितांचा आहे. तिथे योग्य ती परवानगी घेऊन तुम्ही रसग्रहणात पूर्ण कवितेचा अंतर्भाव करू शकता.

एक लक्षात घ्या की तुम्हाला हे करण्यापासून कोणी रोखत नाही आहे तर असलेल्या कायद्याचा आदर ठेउन योग्य त्या मार्गाने हा उपक्रम करण्याबद्दल संयोजकांचं आणि मायबोलीचं धोरण आहे.

एखाद्या कलाकृतीचा/साहित्याचा कमर्शियल किंवा आर्थिक लाभासाठी वापर केला जात नसेल तरीही अशा मोफत सादरीकरणाने ,उल्लेखाने त्या कलाकृय्तीचा व्यापारी खप कमी होऊन लेखक/ प्रकाशकांचे आर्थिक नुकसान होऊ शकते की नाही? त्यामुळे मोफत असो वा पेड प्रताधिकार लागूच असावा असे वाट्ते कारण निर्मात्यांचे आर्थिक हितसंबंधांचे रक्षण झाले पाहिजे. याबाबत चिनूक्ससारख्या माहीतगार व्यक्तीने खुलासा करणे आवश्यक आहे.

एक कविता हा काव्यसंग्रहातला extract च आहे. पूर्ण काव्यसंग्रह कोणी पुनर्प्रकाशित करत नाहीये. प्रताधिकार कवितेगणिक नसतो, पुस्तकागणिक असतो. तेव्हा एक कविता देऊन रसग्रहण करायला कायद्याची अडचण येऊ नये.
कवितेगणिक प्रताधिकार असतो असं कोणी लेखी पुराव्याने सिद्ध केल्यास त्याचा विचार करता येईल.

<प्रताधिकार कवितेगणिक नसतो, पुस्तकागणिक असतो. >
चुकीची माहिती. प्रताधिकार कवितेगणिक असतो. एक कविता ही संपूर्ण कलाकृती समजली जाते.

प्रत्येक कविता ही कलाकृती म्हणून एक स्वयंपूर्ण वस्तू असते, त्यामुळे प्रताधिकाराचे नियम त्यालाही लागू होणारच.

>> खरेतर एखाद्या पुस्तकातील एखादीच कविता दिली, तर बाकीच्याही वाचायला हव्या म्हणुन खप वाढुही शकेल. <<
हे तर्कशास्त्र उचित वाटत नाही, कारण :
१. समजा, एखाद्या प्रकाशित (ओघानेच प्रताधिकारित) काव्यसंग्रहात १० कविता आहेत; त्यातली कविता क्र. १ संयुक्ता-आयोजित म.भा.दि. २०११ कार्यक्रमात पूर्णत: उतरवली. उरलेल्या ९ कविता असेच स्पष्टीकरण देत अन्य ९ मराठी संकेतस्थळांनी इंटरनेटावर उतरवल्या (किंवा मायबोलीवरच २०२१ सालातल्या म.भा.दि. कार्यक्रमापर्यंत उतरवल्या गेल्या :फिदी:), म्हणजे अख्खं पुस्तकच इंटरनेटावर उपलब्ध होईल, आणि सर्वच्या सर्व संकेतस्थळे 'उचित वापर' (फेयर यूझ) तत्त्वाचे समर्थन पुढे करत बगला वर करून मोकळी होतील. न्यायशास्त्राच्या दृष्टीने हा प्रसंग टाळायच्या हेतूने कायद्यांची व्याख्या मांडली जाते. म्हणूनच काव्यसंग्रहाला प्रताधिकाराच्या दृष्टीने एक एकक (युनिट) न मानता, त्यातील एकेका कवितेला प्रताधिकारासाठी एक एकक मानले जाते.
२. समजा 'उचित वापर' तत्त्वाच्या ढालीखाली एखादी कविता खुल्यावर मांडायची असे ठरले, तरीही कोणती कविता खुली होऊ द्यायची, याचा निर्णय कोण घेणार ? असा निर्णय घेणारी कोणतीही आर्बिट्रेशन कमिटी उपलब्ध नसल्यामुळे, लोक आपापल्या पसंतीने १० कवितांपैकी कुठलीही एक निवडून इंटरनेटावर उतरवतील. अश्या अंदाधुंदीत अख्खा काव्यसंग्रहच फुकटात इंटनेटावर यायची शक्यता वाढते. एकदा हे साहित्य फुकट मिळू लागले, की पैसे खर्चून कोण कशाला पुस्तक खरेदी करेल ? (अश्याने मायबोलीचा 'खरेदी' विभागदेखील अडचणीत यायचा Wink )

>> प्रत्येक कविता ही कलाकृती म्हणून एक स्वयंपूर्ण वस्तू असते, त्यामुळे प्रताधिकाराचे नियम त्यालाही लागू होणारच.

बाकी ही चर्चा 'अशाने सगळ्याच कविता इन्टरनेटवर प्रकाशित झाल्या तर (मायबोली खरेदीचं Happy ) काय होईल' अशा "हायपोथेटिकल सिच्युएशन"बद्दल नसून एक कविता घेऊन तिचं रसग्रहण करणं हा प्रताधिकार कायद्याचा भंग होतो का - इतकीच आहे.

वरची चर्चा आणि कॉपीराईट अ‍ॅक्टचा वर दिलेला मसुदा (विशेषतः शरद यांनी ठळक केलेला भाग) पाहता त्याचं उत्तर 'नाही' असल्याचं दिसून येतंय.
