Around the same time that a Magassasy award is given to someone for his role in Right To Information, the Govt. is trying to introduce clauses that will obfuscate our rights.

A relay fast is being organised. Spread the word

CALL FOR A GLOBAL RELAY FAST TO PROTEST THE RTI ACT AMENDMENTS



This is a call to all Indians world-wide, who wish to see a strong, empowered, democratic
India, free from the shackles of corruption, to come out and voice their protest against
the recently proposed amendments to the Right to Information Act by sitting in a fast in
solidarity with our partners in India who have decided to go on a hunger-strike until their
demand to not tamper with the Act is met by the government.

Sandeep Pandey (Asha Parivar), an RTI crusader and a Magsaysay Award winner in 2002, is
sitting on a fast from the morning of 8th August, 2006, in Jantar Mantar, New Delhi, till
the demands of the numerous NGOs (which include, among others, Parivartan and the
National Campaign for People's Right to Information (NCPRI)) and civil-society groups of
leaving the RTI Act untampered, are met by the government.

We request all our friends and supporters around the world to join us in a global relay fast
starting on August 9.
* We call upon Indians from all over the world to fast in solidarity with our grassroots
partners in India who have struggled for over a decade to bring us the RTI Act, only to
see it being mutilated by the government less than a year after its enactment.
* We call upon Indians from all over the world to fast in protest against the proposed
amendments to the RTI Act, which would make the Act completely ineffective and give
reuge to corrupt officials under the garb of secrecy.
* We call upon Indians from all over the world to fast in order to save our democracy and
to eliminate the malaise of corruption from the lives of citizens.
* We call upon Indians from all over the world to fast in remembrance of the lives of
honest officials and citizens, which were lost, trying to safeguard our nation from the
clutches of corruption.
* Together, our voices and our pledge to fast, will convey to the government that the
entire citizenry is ready to transcend all barriers and make a serious committment to
participate in the fight against corruption.

Some Tips:

- You can decide to fast for 12, 24 or more hours (but not more than 72 hours at a time)
- You will be expected to not eat anything (except water and, if necessary, essential fluids)
during the fasting period.
- Please go through the information about safe-fasting before you decide to join.
- You can participate in the fast from wherever you are, at your home or workplace.
- If you can congregate with others while fasting, you are encouraged to do so, and inform
us.

साॅरी मंडळी, ही माणसे बेजबाबदार आहेत.... हे विधान मी जबाबदारीने करतोय. माहीतीचा अधिकार, अण्णा हजारे यांचेशी माझा अत्यन्त जवळून संबंध आहे.
या लोकानी amendmend bill वाचलेय का तरी याचीच मला शंका आहे. तुम्ही वाचलेय का बंधूनो? की केवळ celebreties आहेत म्हणून पाठिम्बा देताय?
transparancy म्हणजे कपडे काढून उघडे बसणे नव्हे....

ते कसे आहेत हा विषय सोडुन देउ. अण्णांची स्टंटबाजी हा वेगळा विषय होईल.

पण दुरुस्तीमधल्या मला न पटलेल्या गोष्टी अशा.

(१) फाईल नोटींग्स दडवण्याचा अधिकार.
(२) राज्य पातळीवर माहिती अयोगाला असलेले शिक्षेचे अधिकार काढुन घेणे.

मी या विषयातला तज्ञ नाही अज्ञ आहे. बिलही मूळ स्वरूपात वाचले नाही. त्यामुळे ही माहिती चुकीची असू शकते.

रॉबिन, तुम्ही संपूर्ण विषय सविस्तर मांडल्यास व उपयुक्त त्या लिंक संदर्भासाठी दिल्यास विषय समजायला फार मदत होईल.

माझे म्हणणे एवढेच आहे की प्रशासनातील भ्रष्टाचार आणि अकाउंटेबिलिटीचा अभाव रोखायचा असेल तर अनावश्यक बाबीतील गोपनियता पूर्ण बंद केली पाहिजे.
प्रशासकीय अधिकारी हे जनतेचे नोकर आहेत, आम्ही त्यांचा पगार देतो याचे प्रतिबिंब कार्यपद्धतीतही दिसले पाहिजे आणि त्यांना कामाचे काय झाले, एखादा निर्णय कसा घेतला याचा जाब विचारता आला पाहिजे आणि त्याचे खरे आणि समाधानकारक उत्तर देणे बंधनकारक असले पाहिजे.

जनतेचे प्रतिनिधी यासाठीच असतात, पण आता जग फार पुढे गेले आहे, तंत्रज्ञान, दळणवळण उपलब्ध आहे तेंव्हा जी माहिती जनतेच्या प्रतिनिधींना मिळू शकते ती जनतेलाही मिळाली पाहिजे.

पूर्ण अनुमोदन.

अण्णांभोवतीचे कोंडाळे आणि काही बाबतीतला अण्णांचा ढिसाळपणा (उदा. trust वेळेवर audit न करणे वगैरे) ह्या बाबी चळवळ बदनाम होण्यास कारणीभूत आहे. पण Gs1 म्हणाल्याप्रमाणे तो वेगळा विषय आहे. सद्यस्थितीत जर भ्रष्ट नोकरशहा आणि राजकारणी युतीला शह द्यायचा असेल तर माहीतीचा अधिकार अत्यावश्यक आहे. तुम्ही सुचवलेला bill वाचण्याचा प्रस्ताव मात्र अतिशय योग्य आहे.

निर्णयामागील ज्युनियर अधिकार्‍यान्ची टिप्पण्णी महत्वाची की अन्तिम निर्णय महत्वाचा?
ज्युनियर्सच्या शेर्‍यान्नी निर्णय बदलत असतील तर ते अधिकृत कसे नाहीत?
असे शेरे हा निर्णय प्रक्रियेचा भाग असेल तर तो झाकुन का ठेवला जातो?
तो जर निर्णय प्रक्रियेचा भाग नसेल तर असे शेरे टिपण्ण्या मारल्याच का जातात?
वगैरे वगैरे....!

तुम्ही माहितीच्या अधिकाराबद्दल सविस्तर (म्हणजे तो नक्की काय होता? त्यात कशा स्वरुपाच्या दुरुस्त्या झाल्या? ह्या दुरुस्त्यांनी काय फरक पडला?) लिहाल तर फारच छान होईल.

माहितीचा अधिकार तर हवाच. म्हणजे नागरिक जागृत झाले तर भ्रष्टाचार आटोक्यात येईल. पण याचा गैरप्फ़ायदा घेतला जाण्याची शक्यताही काही प्रमणात जाणवते.

म्हणज, भारतीयच जर परक्यांशी संधान बांधून इथे अराजक माजवत असतील, तर संवेदनशील माहिती कितपत उघड करायची, ह्याचाही विचार करावाच लागेल.

शिवाय, राजकीय विरोधक म्हणजे "शत्रु" असे वातावरण आहे. राजकीय प्रतिस्पर्ध्यावर मात करायला ह्या कायद्याचा गैरवापर होऊ शकतो, असेही वाटते.

पण हे सगळे ढोबळ माहितीवर आधारलेले अंदाज आहे. ज्यांना अधिक माहिती आहे, त्यांनी उद्बोधक लेख वगैरे लिहिल्यास छान होईल.

राज्य पातळी वरील शिक्षेचे अधिकार काधून घेणे म्हणजे सरकारी कर्मचार्यांना मोकळे रान देणे असे वाटते.

What is Right to Information (RTI): Right to Information (RTI) is implicitly a part of fundamental rights under Article 19(1) of the Constitution of India, which says that every citizen has freedom of speech and expression. As early as in 1976, the Supreme Court said in the case of Raj Narain vs State of UP that India is a democracy, where people are the masters. Therefore, the masters have a right to know how the governments, meant to serve
them, are functioning.

Moreover, the right to information is at the core of the human rights system because it enables citizens to more meaningfully exercise their rights, assess when their rights are at risk and determine who is responsible for any violations ( CHRI website)

However no attempt was made by the governments to enact and implement a regime for accessing information till grassroots campaigns were launched by the civil society - most notably, the movement in the early 1990s in Rajasthan by Mazdoor Kisan Shakti Sangathan (MKSS),
demanding access to villages accounts and transparency in administration, brought RTI into national focus.

After years of campaigning, the national government yielded, passing this long-overdue landmark Act on 12th October, 2005. The RTI Act lays down the process in which information can be accessed from government sources.

So what is this recent hullabaloo? The Indian Cabinet decided to approve an amendment to the RTI Act which will restrict access to "file-notings" under the RTI Law

But what exactly are FILE NOTINGS and Why are they IMPORTANT: That sacred creature, the government file, usually has two halves: on the right side is the correspondence and materials. This could be someone's grievance, a project proposal, a tender, a concept for a
policy, anything the government needs to consider. On the left is the closely held note sheet, which records how the proposition was examined. The advice given in the notings has to be strictly in accordance with laws, rules, norms, and orders. The concerned officer puts down views, advice and recommendations. The file then goes up the line to the decision-making authority. On the way the hierarchy adds more notes, putting their signatures against their views. With all advice in hand a justifiable decision must be made.

Cumulatively, the note sheet reflects the mind of government, bares the intention of an individual officer and whether his advice and consent were grounded on established rules. File notings, then, are X-rays of government functioning. They are proof of fair play and
reason , or dishonesty, bias, and negligence. They are the shield that most honest bureaucrats wish they had and the sword that dishonest ones fear. It is only by allowing
thorough public scrutiny of the evidence of how the government works at every level that corruption can be fought. File notings fall squarely within the definition of 'information' in the Act. The nature of file notings is inevitably that of advice/opinion, and these are
explicitly covered. To twist the definition to exclude file notings would be to destroy the Act's legislative intent. Yet that is what is being sought. Despite clear enunciation that file notings fall within the Act, the Department of Personal and Training's website, says that "information means any material in any form including records, documents...but does not include file notings".

The Indian Govt Withdraws RTI Act Amendments



In a major victory for Indian citizens, who raised a unified voice against the proposed
Amendments to the Right to Information Act, the Indian government decided to withdraw the
proposed changes to the existing Act and promised to follow the democratic process in any
future action on this issue. Anti-corruption crusader, Padma Bhushan, Shri Anna Hazare, who
was on an indefinite hunger-strike, has welcomed the decision and called off his fast on
August 19th, as did Sandeep Pandey, Magsaysay awardee, a few days earlier. In solidarity, the
Save Right to Information Campaign, has also called off all scheduled plans for global
hunger-strikes, demonstrations and protests and joined in the celebrations.
