Hi Mili, Indian Customs rules baddal khai goste lakshat thev 1)You can carry dutiable goods till 12000 IRs. 2)Wearing gold for personal use in no prob. but if you carry 24carat gold it is taxable. 3)they come to know about you after looking at your face and your luggage.so Dress decently and soberly and be confident and don't rush (ghai karu nakos). 4) If they ask you unresonable money ask them to write that article on your passport and you would be taking that back. 5) be patient. 6) there is no duty on the clothes. 7)Do not forget to carry the receipts of the goods you think would be under duty. Does anyone know about what exactly is the rule about carrying foreign currency or cash to India? whats better to carry : TCs or cash? esp. when one is on an assignment in another country for some period of months ? (and whats the best way to encash TCs in India? Some banks do convert TCs to cash but they note the passport number. Do not know whats the implication of that.)

Gundyabhau ani itar, 1.One can carry cash equivalent to USD 2500/- in any currency(Hi figure agdi latest nahi, bahutek limit vadhliy). Tyapeksha jast rakkam pan tumhi neu shakta pan ti customs madhe declare karavi lagte ani currency declaration form chi ek copy tumhala milte ti banket dakhavli ki u can convert to INR or make FDs etc. Yala pan ek palvat ahe ki u can carry more than USD2500/- without declaring and while encashing each time u encash around USD2000/- so the bank or money changer won't ask for CDF. Hi limit per person ahe, tyamule Shree ani Sau aslyas USD5000/- paryant carry karayla kahich harkat nahi. There r no implications of noting the passport number for encashing TCs or even cash unless untill money comes from "hawala" transactions. so don't worry about that. Customs duty sathi if one is returning after a stay of around one year he can carry goods valued upto Rs.12000/- tyamule ganesh if u r coming after a year u can carry telescope. Mazha swatahacha don velecha anubhav ahe ki mi yetana green chhanel madhun alo, tyapaiki eka veles officerne kahi electronic vastu ahet ka ani kiti varshane yatay he vicharle, mi 1 1/2 varshane yetoy mhatlyavar tyane pudhe kahich chaukashi keli nahi. namaskaar mandaLi, me palmcorder ghetala aahe around 750$ aani ghari nyayacha aahe. me 11 maninya nantar ghari jaat aahe. and that value is much more than 12000 Rs.(duty free allowable), so is there any other(?) way to clear customs.

Somesh if u r going to return back then just get it endorsed on ur passport (I suggest u do it only if they ask u else just walk through green channel.) If u r going back for good then option is to pay the duty.

There are 2 things. One id Export from Korea and second is Import into India. These 2 things are independent and all rules are according to each country's government. I do not know about Korea. That you'll have to find out using local sources/web-sites. As long as Indian Customes rules are concerned, you are allowed to bring in your 'Personal belongings' duty-free. Personal belongings means the things you use and which are not brand new. Apart from this, a NEW camera / cam-corder and a laptop can be imported duty free. Also, if you are bringing the thing back (Indian Custom call it as Re-exporting), they are required to be marked on your passport accordingly. There are no customs duty in this case. My personal suggession is, if you are worrying only about this cam-corder (I assume u don't have any other things to declare) you should go through Green channel (Do not declare anything). If at all Custom Officer finds you, There is nothing unofficial you are doing. you can tell them, this is my personal belonging and I'll be taking that back with me. Even if you are not taking it back, it is duty free under the term 'Personal Belonging' Have a nice Journey Kiran

Latest Customs Rules Updates... 1. No Electronic item is duty-free now, even if it is old & used. 2. If you produce a bill/receipt stating its amount in foreign currancy the calculation goes this way: a. Let's say you have a laptop purchased 1 yr back for $1000 & you have a receipt for it. b. They add 20% to the price shown on it called as (Frieght Charges or something similar to arrive at local market value) = $1200 c. The Current exchange rate is applicable to the goods: $1200 * 45 = Rs.54000/- d. All Computer Items are having following depreciation rates: 7% / qtr for 1st & 2nd year. 5% / qtr for 3rd & 4th year. 3% / qtr for 5th year. Upto maximum of 90% depreciation. In our case we'll get 7 * 4 = 28% depreciation. Thet makes the price of the good = Rs.54000/- * (1 - 0.28) = 38800/- e. ANY DEPRECIATION CANCELS THE FREE ALLOWANCE EXEMPTION OF RS 12000/- SO IF THE DEPRECIATION COST IS LOWER THAN THIS EXEMPTION, MAKE AVAIL OF THE FREE ALLOWANCE INSTEAD OF THIS. f. The Duty is plane 50% on all electronic goods on the dutiable cost. i.e. 38800 / 2 = 19440/- These Rules are as on 23-Aug-2003

Milindaa: you are right. Rangy: If you carry any electronic item while travelling to India but do intend to carry it back with you while leaving india then you can get that item specifics stamped on your passport by the custom officials then "NO DUTY" is imposed on those items. But make sure you carry them back while leaving india as customs will check your passport for any such stamps while leaving else you will have to pay duty on those items.

kiran - a small error in your calculation of depreciation. the new cost after a year is not 72% but 74.8% of the original cost (depreciation gets compounded is what i'm assuming). not trying to be finicky, but if you are talking about a 54000Rs laptop - then that difference still comes out to 1512Rs (about 35$).

Yogi, I don't think they stamp the passports these days. Most of the times, showing them the return ticket and the visa would suffice. If thye are not convinced, may god bless you (with the money)!

For laptops and most used elect. items (Cameras, cellphones etc.) they do not stamp the passports as long as you have a return ticket (that too is asked not checked) so its a formality. If something gets stamped, make sure to bring it back in the Hand-Luggage as the stamp removal is done after checkin and immigration check

ABedekar, you are right in your calculations but for my case they did the calculations the way I specified above (I had that doubt in my mind but I didn't pay attention to that). OK. now some replies: 1. Custom duty need not be paid by Passangers who are visiting India for vacation and they are taking the items back in US (Re-exporting). However they are now strict and ask you for some proof such as your return ticket, Visa validity, etc. Here lies some gray area. If the Custom Official is not satisfied with the evidence you have produced, you may have to deposit the item in their warehouse and check in directly when you leave India. There are some alternatives to this, I'll post it when I'll get some time. 2. Although the custom duty is pretty hefty and unexpected (for me, it came as a shock!), as a true Indian, I suggest all the NRIs to pay it as it is a duty of a responsible Citizen. 3. Higher Level Authorities are often found helpful, so you can contact them in case of any questions. But they can only support you if you are not doing/intending anything illegal. They carry a handbook which is supposed to be used by all the Custom Officers, which contains the calculation rules, etc. 4. Always preserve the original receipts of all the costly electronic Items you purchase and intend to use it in India. The Bill should also contain the serial/model number of the Item purchased, they match the bill against the actual item. 5. Let the officer calculate the duty first, if it is higher than what would come using the method I had shown, tell him that you have the receipt. 6. If you plan to pay duty, you don't have to stand in the looooong queue of Green channel(and again might get caught while screening!). You can directly go to the red channel and let them know what you want to declare. They have now stopped harassing people because everything is now official and they cannot get a paisa for themselves even if they find more dutiable items. I could see that many people could peacefully declared the items, paid the duty and out they went within 15 mins of time. 7. MOST IMPORTANT: WHEN YOU ARE TAKING A CUSTOM DUTY PAID ITEM OUTSIDE INDIA, GET AN EXPORT CERTIFICATE FROM THE CUSTOM OFFICER WHILE DEPARTING. YOU NEED TO SHOW THE ORIGINAL DUTY RECEIPT FOR THIS PURPOSE. Next time when you travel to India, you can again go to red channel and show them the export certificate so that you do not have to pay the duty again. By the way, this all information is based on my recent visit to the customs department to pay the duty for my laptop which I kept in their warehouse under the title "payment of duty". The trip was 4 hours long and since I was not tired at that time unlike in normal case I could actually see the transactions happening in front of me and was enjoying. Any more queries??

Kiran..what do u mean by keeping the item in their warehouse and taking it back next time when u travel out ? then whats whole use of carring the item ? say laptop..one carries to india to use it during his visit..and gets back when he travels back. I didnt get the point of depositing the item in their warehouse. will u pls clarify ?

Asami: Yes, Now it is made mandatory for higher level authorities to be present at all the time. In fact now there are Notice boards displayed regarding the Customs Rules and whom to contact in case of doubt/enquiry. The Deputy Commissionor of Customs is available at the far end of the lobby. As a starting point you can contact P.R.O. (Public Relationship Officer) to address your query. He/She is located at the center table between the red & Green channels and marked clearly. Sandeep: It only happens in case you are unable to produce satisfactory proof to the custom officers regarding your return from India. As I told earlier there are some alternatives to this which I'm stating it below: a. You can pay the customs duty as per the rule, take the item with you and while leaving India, you can ask for re-payment of the duty. They deduct some amount proportionate to the period you stayed in India (I don't know why!). b. You can produce a truth statement and a bank-guarantee equalling amount of custom duty. This option cannot be available on the spot. you need to deposit the item with them and later produce the bank guarantee. It is meant for the purpose that if you do not leave India within the the date you specified / maximum permissible limit (again I don't know how much it is.) they will get the money from the bank. c. You pay the customs duty and get an export certificate while leaving. This is when you want to bring the item finally to India. d. If you feel the customs duty is high and you can produce more evidence at a later point of time, you can leave the item there under the clause "Re-evaluation" and produce necessary evidence later. They operate in 3 shifts (batches). so it is better to ask for when is their duty on the day you'll be visiting again. I had my first visit in vain because of wrong batch on duty. I would suggest you to clear all the issues on the spot, although it means, it is going to take some more time. Specially it is not possible for people outside Mumbai to visit the airport again. But if you are staying in Mumbai and you feel that you have strong evidence for whatever you are claiming (make sure to ask the custom officer that the evidence you'll be producing will be sufficient and WRITE down his name and batch number)

Some recent changes made in Indian Customs rule for NRI's. NEW DELHI: On the eve of the second Indian diaspora meet being held here from Friday, the government announced a slew of sops for non-resident Indians (NRIs) planning to return home after a long stay overseas. As part of changes made in indirect taxes for products and services in several sectors effective from Friday, the government decided to exempt duty on six products that form part of household goods of a person returning home on transfer of residence. "Duty on six items, namely VCD/VCR, washing machines, personal computers, laptop computers, refrigerators of capacity up to 300 litres, and cooking range under transfer of residence are being made duty free," the official statement issued by the finance ministry said. In the case of 17 other articles, the government halved the duty from 30 percent to 15 percent. Other baggage rules liberalised for NRIs included cinematographic films, exposed but not developed and imported as part of baggage, which was made duty free. Also, the government allowed duty free import of two litres of alcoholic liquor or wine as part of baggage instead of one litre. Similarly, laptops brought as part of baggage by NRIs will be exempt from customs duty, the statement said.
