Posting this for a friend of mine. The company is shutting down and he has got his labour/I140 approved. In the current situation, is there any way he could save this work. He will need time to get another job though. What are his options?

As per new law (i think s2045 ?) you can change employer after 180 days after filing of I485. Your friend will have to start the processing from scratch. Labor clearance is specific to the employer. with the new law his former employer can use his labor approval for another employee though.

Sayali, times vary from case to case for no reason, but in CA in the current scenario, it's taking 9-12 months from date of I-485 filing to GC stamping.

Situation: I-140 and I-485 is filed approx 2 months back simultaneously, received EAD, finger printing is on the way, Company is not doing good and lays off, What are the consequences!!! Can the person work in other company on EAD before 180 days of filing I-485? Any better option than leaving the country or transferring H1?

yes.. if he gets layed off.. he can join anyone based on EAD.. provided.. title is same.. as labor cerf. that's the whole purpose of EAD.. else why would you need EAD if you are going to work with the same employer.. do now worry at all and change job based on EAD.. nothing is going to happen.. only you might have to provided evidence of job if INS asks .. that's it.

moreover, how long can one remain w/out job on an EAD. that is, how much time does one have to search for a job on EAD ? is it till the validity of the EAD ?

Thanks Yogi, but I was specifically told that DOL is not allowing any GCs to be processed in IT area due to economy conditions. I wanted to validate this news.
